Terms of Service
Last updated: 7 October 2026
1. Acceptance
By creating an account or using MyHermes, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the service. These Terms form a binding contract between you ("you", "your") and MyHermes ("we", "our", "MyHermes").
2. The service
MyHermes provides access to an AI agent ("Hermes"). The Free experience may run on shared infrastructure. Paid plans provision a private containerized environment with persistent storage, scheduled tasks ("cron jobs"), and autonomous actions across integrations you authorise. Features and resources vary by plan as described on the pricing page at the time of purchase.
Some plans include AI credits for supported models. You may also connect your own LLM API key for a compatible provider. Included AI credits and any additional usage options are described on the pricing page; you remain responsible for charges incurred directly with a provider whose key you connect. MyHermes AI plans include a weekly usage limit, measured in dollars of usage at our published per-token prices, and it resets every 7 days from the start of your billing period. Unused allowance does not carry over. If you move to a higher plan, your current plan ends at once and its unused allowance for the rest of the period moves to your credits. Credits you buy do not expire with a plan.
Mini and Pro include limits on how long your agent's machine runs in any 5 hours and in any 7 days, and Max includes a limit in any 7 days, shown as percentages on the Usage page. You can buy machine credit to keep your agent running past those limits. Machine credit you buy does not expire with a plan and is not refundable once spent.
The Neo Pass is included with a paid plan. It refills weekly, has no cash value and does not carry over. When it is used up, requests may be served by shared everyday models run by third parties. Those providers may keep prompts under their own policies, so do not rely on those for sensitive work.
3. Account and eligibility
You must be at least 18 years old and capable of forming a binding contract under applicable law to use MyHermes. Accounts are single-user; you may not share credentials or allow others to access your account or agent environment. You are solely responsible for all activity under your account.
4. Subscription and billing
Subscriptions are priced in US dollars. At checkout our payment provider may show and charge the price in your local currency, with its currency conversion fee added on top. Prices are as displayed on the pricing page and are subject to change with 30 days' notice for renewal periods. Dodo Payments processes all transactions; you agree to their payment terms as part of the checkout flow.
You may cancel your subscription at any time from the dashboard. Cancellation takes effect at the end of the current billing period. When cancellation takes effect, we attempt to create a recovery backup and promptly destroy the dedicated container; if automated cleanup fails, destruction may take up to 7 days. We do not issue partial refunds for unused days, except where required by applicable law (e.g., certain jurisdictions under consumer protection law).
New to MyHermes and it isn't for you? On Mini or Pro, email [email protected] within 7 days of your first subscription payment and we will refund that payment in full. This applies once per person, to the first payment of your first subscription only. It does not cover Max, upgrades or credit you buy. After a refund we cancel your plan and remove your agent within a few days.
Failed payments may result in suspension of paid-plan services after 14 days. We reserve the right to recover costs of Dodo Payments or other payment processor reversals and chargebacks.
5. Your data and content
You retain full ownership of all content your Hermes agent processes — messages, files, prompts, outputs, and data stored for your account or agent environment ("your content"). We do not claim any rights over your content. API keys and other secrets you connect are encrypted at rest and used only to provide the requested service or integration.
When a paid plan ends, its dedicated container and associated data are destroyed as described above. A post-cancellation recovery backup may be retained for up to 30 days, then permanently deleted.
6. Acceptable use
Do not use MyHermes to:
- Engage in illegal, fraudulent, or harmful activity of any kind
- Generate, distribute, or store CSAM, non-consensual sexual content, or content that violates others' rights
- Send unsolicited bulk communications (spam)
- Scrape or harvest data from services in violation of their terms
- Use the service in a way that violates your LLM provider's acceptable use policy
- Attempt to gain unauthorised access to any system or container
- Use the service to host or serve malware
We may suspend or terminate accounts that violate these terms without notice and without refund if the violation is material.
7. Service availability
MyHermes is in early access. Standard plans are provided best-effort without an uptime SLA. Planned maintenance is communicated via the status page where feasible. Unplanned outages are addressed as quickly as possible but do not entitle you to compensation.
Enterprise customers may request a signed SLA with specific uptime guarantees. Such SLAs must be signed separately and are not effective unless in writing.
8. Third-party services
MyHermes depends on third-party infrastructure: Clerk (authentication), Dodo Payments (billing), Convex (control plane database), Fly.io or Modal (compute), Resend (email), and Vercel (hosting). We are not responsible for the acts or omissions of any third party. Your use of their services is subject to their respective terms and policies.
9. Intellectual property
MyHermes, its name, logo, design, documentation, and all proprietary technology are owned by MyHermes. You are granted a limited, non-exclusive, revocable licence to use the service for its intended purpose. You may not copy, reverse-engineer, or create derivative works of MyHermes technology without written permission.
Your content remains your property. You grant us a limited licence to host and process your content solely to provide the service.
10. Modifications to these terms
We may update these Terms from time to time. Material changes (e.g., new fees, liability changes, prohibited uses) will be communicated by email to active subscribers at least 30 days before they take effect. Your continued use after the effective date constitutes acceptance of the revised Terms.
11. Disclaimer
MyHermes is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the fullest extent permitted by law, MyHermes's total liability for any claim arising from or related to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, even if advised of the possibility of such damages.
13. Indemnification
You agree to indemnify, defend, and hold harmless MyHermes and its officers, employees, and agents from any claim, demand, or damage (including reasonable attorneys' fees) arising from your use of MyHermes, your violation of these Terms, or your violation of any third-party rights.
14. Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising from or related to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India. You waive any objection to venue in those courts.
